Please read these Terms of Service ("Terms") carefully before using the YoBPM application ("the App").
1. Acceptance of Terms
By downloading, installing, or using YoBPM, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
YoBPM is a mobile application that broadcasts heart rate data from your Apple Watch to third-party applications (such as Zwift) via Bluetooth. The App requires:
- An iPhone with iOS 17 or later
- An Apple Watch Series 4 or newer with watchOS 10 or later
- Active Bluetooth connectivity
3. Subscriptions and Payments
YoBPM offers the following purchase options:
- Weekly Subscription: $1.99/week with a 7-day free trial
- Lifetime Access: One-time payment of $14.99
Subscriptions are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases.
Weekly subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage your subscription in your App Store account settings.
4. Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their standard refund process.
5. Health Data Disclaimer
YoBPM is not a medical device. The heart rate data provided by the Apple Watch is for fitness and informational purposes only. Do not rely on this data for medical decisions. If you have concerns about your heart rate or health, consult a healthcare professional.
6. Accuracy of Data
While we strive to provide accurate heart rate broadcasting, we cannot guarantee the accuracy of data from the Apple Watch sensor. Factors such as watch fit, movement, and skin conditions may affect heart rate readings.
7. Third-Party Services
YoBPM is designed to work with Zwift and other third-party applications. We are not affiliated with Zwift or any other third-party service. The availability and compatibility with third-party services may change without notice.
8. Intellectual Property
The App, including its design, features, and content, is owned by YoBPM and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
9. Limitation of Liability
To the maximum extent permitted by law, YoBPM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages for loss of data, loss of profits, or business interruption.
10. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
